CONDITIONS OF SALE

Our online sales system, which requires active action by the Customer, has been designed in compliance with the regulations on distance selling, in particular the articles. 49 and following of the Consumer Code (Legislative Decree no. 206 of 6 September 2005 and subsequent amendments and additions). The use of the distance selling process described in these general conditions of sale is reserved for consumers as defined by the art. 3 of Legislative Decree 206/2005, provided that the products are delivered in Italian territory (hereinafter, "Customer" or "Customers").

1. Scope
These general conditions of sale apply to all sales of products carried out remotely via the MEDEAOLINE.IT website. They must be carefully examined by the Customer before completing the remote purchase. Placing an order on the site implies complete knowledge and acceptance of these general conditions of sale. When the Customer places an order through the site, he unconditionally agrees to comply with these conditions, including the payment conditions explained below. Any exceptions to these conditions will be valid only if agreed in writing between the parties. These conditions will remain in force until they are published on the MEDEAOLINE.IT website. Any changes will only be applicable to orders placed after the publication of the new conditions.

3. Product information
The information on the products available for distance selling via the MEDEAOLINE.IT website is provided in compliance with current laws, in particular articles 49 and 51 of the Consumer Code.

4. Order of the product and conclusion of the contract
The presentation of the products on the site constitutes an invitation to make an offer. Orders can be placed through the site by selecting the product and following the specified instructions. The Customer must be an adult (at least 18 years old) and have the legal capacity to enter into binding contracts.

After submitting an order, the Customer will receive an email with the order number and details relating to the products, price, shipping address and payment methods. This email does not constitute acceptance of the order, but only confirmation of receipt.
MEDEA SRL will verify the availability of the products ordered and the correctness of the information provided by the Customer. The sales contract will be concluded only with the sending of a separate email of acceptance and/or shipping confirmation.
The contract could be rejected due to incorrect information, product exhaustion, insufficient solvency guarantees, orders that do not correspond to normal consumer needs, or due to causes of force majeure. If an order cannot be accepted, MEDEA SRL will inform the Customer within 15 days, immediately releasing the amount reserved for payment.

5. Product price
The price of the products on the site is indicated per single item, expressed in Euros and inclusive of VAT. MEDEA SRL will take care of the payment of all taxes and duties.

6. Payment conditions
The Customer can make payment via:
* Credit card (Visa/Visa Electron, Mastercard, American Express, Maestro International).
* Active PayPal account.
* Cash on delivery (not available if the delivery point is a shop).
* Gift cards.

The total amount of the order is committed to the credit card or PayPal account when the order is forwarded to MEDEA SRL (when the Customer selects "Buy now"). MEDEA SRL uses Cybersource and PayPal for the secure management of payments.
For payments by credit card, the Customer must confirm the card details on the site. For cash on delivery, payment must be made in cash to our partner, with an additional cost of €4.00. If the payment exceeds €4,999.99, it will not be possible to use the cash on delivery.

If the payment is via PayPal account, the Customer will be redirected to the PayPal page to complete the payment. For payments via gift card, you must enter the 16-digit number on the back of the card or in the confirmation email.
If the payment is not successful for technical reasons, the order will not be completed. If the Customer leaves the payment page, he will be redirected to a page indicating the impossibility of completing the order.

7. Delivery
The Customer can choose between different delivery methods:
7.1 Delivery to the Customer's address.
The delivery of the products is carried out exclusively on Italian territory, to the address indicated by the Customer, only after regular payment of the order. It is not possible to request delivery to post office boxes or sorting centers. If the recipient is not present, the courier will make another attempt the next day. If both attempts fail, the courier will leave a notice with their contact details to collect the products at a collection point. If the Customer does not collect the products within 15 days, they will be returned to the warehouse. MEDEA SRL will contact the Customer to arrange a new shipment or refund.
7.2 Delivery to the selected point of sale.
Delivery is carried out exclusively on Italian territory, at the point of sale chosen by the Customer. It is not possible to request delivery to post office boxes or similar. If the Customer does not collect the products within 30 days of notification of availability, they will be returned to the warehouse and a refund will be made.

8. Shipping costs
Delivery is free for all purchases over €99.00. For smaller orders, the shipping cost is €4.99 for Italian territory, excluding the islands, where the cost is €8.99.

9. Right of withdrawal
The Customer can exercise the right of withdrawal within 14 days from the date of receipt of the products, without having to indicate the reasons. To exercise the right of withdrawal, the Customer can:
a) Send the withdrawal form (Annex 1) or another explicit declaration to MEDEA SRL, via email (medeassociazione@gmail.com), with the goods in perfect condition, in the original packaging, with label and documentation received.
b) Return the goods purchased to one of the points of sale indicated, in the same conditions as the delivery.
In the first case, the return costs will be borne by the Customer. If the exercise of the right of withdrawal satisfies the conditions described above, the refund will be made within 30 days of receiving the withdrawal request (in the case under a)), or immediately if the product is delivered to a point of sale (in the case under b)). If payment is by credit card or PayPal, the refund will be made via the same payment method. If by cash on delivery, the refund will be made by bank transfer, in this case the costs relating to the cost of the cash on delivery paid to the courier for this service will be withheld.

10. Returns
The Customer can return the products following these procedures:
10.1 Return by carrier.
If the Customer is registered on the MEDEAOLINE.IT website, he can access his "My orders" section and request a return. If the Customer is not registered, he can contact Customer Service via telephone or email to request the return. Return costs are borne by the Customer.
10.2 In-store returns.
The Customer can return the products to any of the points of sale indicated within 14 days of receipt. Returning to the store is an alternative to returning via carrier.
10.3 Integrity conditions for returns.
The Customer is responsible if the returned products are damaged, incomplete, deteriorated or used improperly. The Customer must ensure that the item has not been used, washed, or has undergone modifications. In particular, products must be returned in their original packaging.
10.4 Items not ordered, damaged or different from the order.
If the Customer receives a product different from the one ordered, he can return it within the terms of the right of withdrawal indicated in article 9.
10.5 Replacement of products.
The Customer can request the replacement of the products within 14 days from the date of receipt, changing size or color, following the procedures indicated previously.

11. Compliance and warranty
The products benefit from the legal guarantee pursuant to art. 129 and following of the Consumer Code. Any complaints for non-compliance must be promptly communicated to MEDEA SRL with a description of the problem. If the Customer receives a non-compliant product, he must make the product available to MEDEA SRL, with the warranty seal intact. The Customer has the right to have the conformity restored, without charge, by replacement. The Customer can also choose between terminating the purchase and reducing the price, in the cases provided for by the Consumer Code.

12. Complaints, Communications, Information
For any complaint, information or communication regarding these general conditions of sale, the Customer can contact Customer Service via the "Contacts" link on the MEDEAOLINE.IT website. It is specified that if the Customer uses a communication channel not described here, MEDEA SRL will not be responsible for any additional costs incurred.

13. Provisions on privacy and protection of personal data
The collection and processing of data are carried out for the management and execution of current and future purchase orders. A copy of the Privacy Policy is available on the site.

14. Force majeure
MEDEA SRL's services may be suspended in the event of force majeure, such as wars, riots, strikes, supply problems, etc. MEDEA SRL will inform the Customer within 15 days. If the suspension lasts beyond 30 days, the Customer can cancel the order and will receive a refund.

15. Applicable law and competent court
These general conditions of sale are governed by Italian law. In case of disputes, the Customer can use the ODR platform according to EU Regulation 524/2013. It is also always possible to contact the judge of the Customer's place of residence.
